Terms and Conditions of Sale

IMPORTANT: Please read these General Terms and Conditions carefully: they define the terms and conditions of sale that the Customer accepts when ordering the Services. These general terms and conditions are enforceable in the same way as any other signed written contract. If the Customer disagrees with the terms of these General Terms and Conditions, s/he is not entitled to make a Booking.

 

Between the undersigned: 

HOTEL LE GRAND MAZARIN, a société par actions simplifiée (French simplified company limited by shares) registered in the Paris Trade and Companies Register under number 822 661 138, the registered office of which is located at 5, Avenue Bertie Albrecht, 75008 Paris, and the VAT number of which is FR10822661138. 

Hereinafter referred to as “HOTEL LE GRAND MAZARIN”,

On the one hand, 

And 

Any natural person wishing to book a room on the website www.legrandmazarin.com

Hereinafter referred to as the “Customer”

On the other hand, 

The parties have agreed to the following: 

 


Article 1.    DEFINITIONS

Customer: refers to any natural person browsing and/or wishing to make a Booking on the Site. 

General Terms and Conditions: refers to these general booking terms and conditions. 

Contract: refers to these General Terms and Conditions and any document attached to them. 

Accommodation: refers to the rooms or suites of the Hotels that HOTEL LE GRAND MAZARIN show and offer for Booking. 

HOTEL LE GRAND MAZARIN: means the société par actions simplifiée (French simplified company limited by shares) registered in the Paris Trade and Companies Register under number 822 661 138, the registered office of which is located at 5, Avenue Bertie Albrecht, 75008 Paris, and the VAT number of which is FR10822661138.

The Internet refers to different networks of servers located in different places around the world, linked together using communication networks, and communicating using a specific protocol known as TCP/IP.

Booking: refers to the reservation of a Service by the Customer on the Site. 

Site: refers to the infrastructure developed by HOTEL LE GRAND MAZARIN  according to the computer formats that can be used on the Internet, including data of various kinds, and in particular texts, sounds, still or moving images, videos, databases, intended to be consulted by the Customer to find out about and book the Services. The Site is accessible at the following address: www.legrandmazarin.com.

Services: refers to any Hotel service presented and offered for Booking by HOTEL LE GRAND MAZARIN, and in particular Accommodation, breakfast, catering or SPA services where applicable. 

Traveller: refers to the Customer and any person for whose benefit the Customer has entered into the Contract and who will use the Services under the conditions set out below. The Customer guarantees that the Traveller will comply with the provisions of these General Terms and Conditions. 

 

Article 2.    PURPOSE 

The HOTEL LE GRAND MAZARIN have a hotel business for which they offer Booking Services on the Site. 

These General Terms and Conditions define the conditions under which HOTEL LE GRAND MAZARIN allows its Customers make Bookings for a Service.

The Customer and HOTEL LE GRAND MAZARIN agree that their relationship as well as access to and use of the Site shall be governed exclusively by:

•    These General Terms and Conditions, to the exclusion of any other conditions and that they shall prevail, where applicable, over any other version or document;
•    The Site Privacy Policy;
•    Applicable laws and/or regulations. 

These General Terms and Conditions define the rights and obligations of the parties in connection with Booking and the use of the Site.  

They are made available to the Customer on the Site where they can be consulted directly. 

The use of the Site and the Booking imply:

•    The Customer’s knowledge and unreserved acceptance of these General Terms and Conditions and the Site’s Privacy Policy.
•    The technical skill of the Customer to use the Site;
•    The awareness for the Customer that the Booking does not require a handwritten signature.  

Each Customer undertakes to respect the purpose of the Site and not to use it in order to divert it from its purpose of presenting Services and Bookings.

HOTEL LE GRAND MAZARIN reserves the right to modify its General Terms and Conditions at any time. 

In the event of any modification, the applicable General Terms and Conditions are those in force on the date of the Booking by the Customer, a dated copy of which may be provided to him/her at his/her request by the HOTEL LE GRAND MAZARIN. 

The fact that HOTEL LE GRAND MAZARIN do not claim that any clause of these General Terms and Conditions apply or consent to its non-performance, whether permanently or temporarily, shall not be interpreted as a waiver of HOTEL LE GRAND MAZARIN’s rights arising for them from the said clause.

These General Terms and Conditions were updated on 10 August 2019. This edition cancels and replaces previous versions.

Article 3.    HOTEL LE GRAND MAZARIN RULES

3.1    Accommodation Categories

Le Grand Mazarin offers six (6) accomodation categories :

-   Classic Room ;
-   Superior Room ;
-   Deluxe Room  ;
-   Parisienne Junior Suite ;
-   Grande Parisienne Junior Suite ;
-   Mazarin Suite ;
 

The detailed characteristics specific to each category of Accommodation are set out on the Site

Dogs weighing less than eight (8) kilograms are allowed in all rooms and suites. A supplement of thirty (30) euros per day per dog will be charged.

3.2    Breakfast

If you have opted for the breakfast rate, breakfast will be included in your final bill at the rate indicated at the time of booking. If you have not opted for the breakfast rate, breakfast will be added to your final bill on the basis of your consumption.

3.3    Check-in et check-out

The Traveler will have access to the Room from three in the afternoon (3pm) on the day of arrival, as stated in the Reservation confirmation, until noon (12pm) on the day of departure, also stated in the Reservation confirmation, unless otherwise agreed by Le Grand Mazarin.

At check-in, the customer must present an identity card and the credit card with which the deposit was paid.

3.4    Availability

The Accommodation is offered for Booking by HOTEL LE GRAND MAZARIN on the Site within the limits of the accommodation available on the dates specified by the Customer. 

In the event of unavailability of a category of Accommodation, after confirmation of the Booking, HOTEL LE GRAND MAZARIN and/or the Hotel concerned will inform the Customer by e-mail as soon as possible. 

The Reservation may then, according to his/her wishes, be cancelled or modified by the Customer if accommodation of another category is available in the same Hotel.

3.5. Swimming pool 
Access to the hotel swimming pool is open to all hotel residents. Minors under 15 must be accompanied by an adult. 

As in all public areas, excessive noise is not permitted at the pool.  Diving is prohibited. 

Running around the pool is prohibited, as there is a risk of falling. 

Dogs are not allowed around the pool, even on a leash. 

3.6.  Cell phones

Out of respect for the peace and quiet of all our guests, cell phones must be switched to silent mode and telephone calls must be made discreetly. 

Vocal use of cell phones is not permitted in restaurants. 

3.7. Dress code

We ask you to dress appropriately when moving around the establishment, including when drinking in our bars and restaurant.  

Swimwear is not permitted in any of the hotel's restaurants, bars or reception areas. 

3.8. Safety

We ensure your comfort and safety during your stay. If you wish, we can provide you with a safe at reception for your valuables.

Article 4.    RESERVATION

Reservations for accommodation can be made via the Site, by email or by telephone.

4.1 Online booking

4.1.1 Choice of accommodation

To make a Reservation on the Site, the Customer must first pre-select the date of stay on which he/she wishes to make the Reservation. 

The Customer is then redirected to HOTEL LE GRAND MAZARIN's partner platform for online Reservations. 

The Customer must then indicate the category of Accommodation he/she wishes to reserve. The Customer will then have the choice of confirming the pre-selected category of Accommodation if it is actually available on the desired dates, or modifying the said category of Accommodation, depending on HOTEL LE GRAND MAZARIN's availability and the average rate displayed per night. 

The Customer will then have access to a summary of the characteristics of the Accommodation and the Services included in the price displayed (for example, breakfast, access to the mini-bar, etc.).

The Customer must then click on "Book". 

The Customer will then have access to a summary of his/her Reservation, including the category of Accommodation, the chosen reservation method, the dates of stay, the number of Travellers, and the price.

Customers must confirm their Reservation by clicking on "Confirm my Reservation", which redirects to a fully secure link.

4.1.2 Communication of information

Once the category of Accommodation has been selected, the Customer must provide contact information, including surname, first name, e-mail address, telephone number and nationality. 

All information concerning the Customer is intended for HOTEL LE GRAND MAZARIN in order to register the Customer's Reservation. The information provided is processed and stored by HOTEL LE GRAND MAZARIN in accordance with the Privacy Policy

Mandatory information is the Customer's surname and email address. Any other information is provided on a voluntary basis by the Customer.

4.1.3 Payment

To complete the Reservation, the Customer must provide a credit card (Mastercard, Visa, American, Express) as a guarantee for the reservation. For reservations of more than seven (7) nights, a deposit of half the total amount of the

Reservation is required.

After the free cancellation period, one night will be charged for late cancellations. For reservations of more than 7 nights, after the cancellation period, 50% of the total amount will be charged.

Reservations must be guaranteed by a valid credit card. 

The Reservation becomes firm and definitive only after payment and collection of the deposit in accordance with the reservation and cancellation conditions for rates for which prepayment is required.  

Once the Reservation has been validated and payment made, the Customer will receive confirmation of the Reservation by e-mail to the address provided, summarizing :

a) Information on the essential characteristics of the Reservation and the Accommodation,

b) The reservation number,

c) The price of the reservation,

d) Length of stay, 

e) Booking cancellation conditions.

4.2 Reservations by email

Reservations by e-mail are made to the following address: reservations@legrandmazarin.com.  

The Customer will then be asked to provide the same information as for online reservations, i.e. the category of accommodation required, the number of travellers accompanying the Customer, and the dates of stay. 

The Customer will then receive a summary of the reservation by e-mail, summarizing all the elements relating to the Reservation, and in particular :

a) Information on the essential characteristics of the Reservation and the Accommodation,

b) The Reservation number,

c) The price of the Reservation,

d) The duration of the stay, 

e) Reservation cancellation conditions.

This summary will be accompanied by the General Conditions.

The Customer must check the contents of this summary as soon as possible, and immediately notify HOTEL LE GRAND MAZARIN of any errors or omissions.

The Customer must validate this summary with HOTEL LE GRAND MAZARIN by return e-mail. This email will constitute validation of the reservation by the Customer and acceptance of the General Conditions.

The Customer will then receive a secure link enabling him/her to complete the registration and payment procedures.

Reservations must be guaranteed by a valid credit card. 
The Reservation becomes firm and definitive only after payment and receipt of the deposit in accordance with the reservation and cancellation conditions for rates for which prepayment is required.  

Once payment has been validated, the Customer will receive official confirmation of the reservation by e-mail to the address provided, together with a summary of the reservation details.

4.3 Booking by telephone

The Customer may make a reservation by telephone on the following number: 04 90 65 99 11 (telephone operator charges).

In this case, the Customer will be asked for the same information as for the online Reservation of the Accommodation. Although this order cannot be considered as canvassing by telephone governed by the provisions of article L221-6 of the French Consumer Code, given that the Customer acknowledges and accepts that he/she initiated the reservation, HOTEL LE GRAND MAZARIN will send written confirmation of the offer made to the Customer. In this respect, the Customer acknowledges and accepts that in order to place an order by telephone, he/she must have a valid email address to which the contractual documents will be sent.

The Customer will inform HOTEL LE GRAND MAZARIN by telephone of the category of accommodation they wish to reserve, the number of travellers accompanying the Customer and the dates of their stay. At the end of the reservation, HOTEL LE GRAND MAZARIN will summarise for the Customer the details of the reservation, and in particular the category of accommodation selected, the number of travellers and the dates of stay.

The Customer shall also indicate the method of payment used.

The Customer will then receive a summary by email summarising the elements relating to the reservation and in particular :

a) Information on the essential characteristics of the reservation and the Accommodation,
b) The reservation number,
c) The price of the reservation,
d) The duration of the stay,
e) The conditions for cancelling the reservation.

This summary will be accompanied by the General Terms and Conditions.

The Customer must check the contents of this summary as soon as possible and immediately notify HOTEL LE GRAND MAZARIN of any errors or omissions. The Customer will confirm to HOTEL LE GRAND MAZARIN by clicking "Confirm reservation". This confirmation will constitute validation of the reservation by the Customer and acceptance of the General Conditions.

The Reservation must be guaranteed by a valid bank card.

The Booking only becomes firm and definitive once the deposit has been paid and cashed in accordance with the booking and cancellation conditions for fares for which prepayment is required.

Once the Reservation has been validated and payment has been made, the Client will receive confirmation of the Reservation by e-mail to the address provided, summarising the characteristics of the Reservation.

Article 5.    PRICES AND TERMS OF PAYMENT

5.1 Price

The price of the Reservation is the current price indicated in the Reservation summary accessible before the Reservation is validated. 

The price is set by HOTEL LE GRAND MAZARIN at its sole discretion, and may be subject to changes and variations over time, particularly depending on the reservation period. 

The price is inclusive of all taxes (VAT and other taxes applicable on the date of the Reservation, excluding tourist tax) and is per Accommodation for the number of Traveller(s), according to the reservation method chosen and the dates selected. The tourist tax is to be paid directly to HOTEL LE GRAND MAZARIN at check-out.

The price includes :

- Accommodation ;
- Buffet breakfast served in the restaurant (if applicable);
- Non-alcoholic beverages from the minibar;
- Valet parking;
- Wi-Fi. 

All Reservations are payable in euros.

Any change in the applicable VAT rate, exchange rate or any other legal or regulatory taxes imposed by the competent authorities may be passed on to the price of the Accommodation offered for Reservation on the Site. 

In the event of an additional guest, the following daily surcharge will apply:

- Child under 3: free 
- Children aged 4 to 12: free extra bed and fifteen (15) euros for breakfast if applicable
- Children aged 13 and over, and adults: one hundred and twenty (120) euros for the extra bed and thirty (30) euros for breakfast if applicable. 

5.2 Payment

The Customer must pay a deposit by credit card (Mastercard, Visa, American, Express) at the time of Reservation corresponding to the price of one night's Reservation or 50% of the total amount of the reservation if it is a special offer in accordance with the reservation and cancellation conditions according to the chosen rate.

For online reservations, HOTEL LE GRAND MAZARIN has chosen Stripe to secure online credit card payments. 

The provision online or via the secure link provided above of the credit card number and/or the validation of the Reservation and its payment shall constitute proof of the completeness of the said Reservation in accordance with the provisions of law no. 2000-230 of March 13, 2000 adapting the law of evidence to information technologies and relating to electronic signatures, and shall constitute payment of the sums incurred by the Reservation.

This validation constitutes signature and express acceptance of all operations carried out with HOTEL LE GRAND MAZARIN, and in particular the Reservation.
However, in the event of fraudulent use of the Customer's credit card, the Customer is invited to contact HOTEL LE GRAND MAZARIN's customer service department by e-mail at the following address: reservations@legrandmazarin.com.

It is expressly agreed that, in the absence of manifest error on the part of HOTEL LE GRAND MAZARIN, the data stored in HOTEL LE GRAND MAZARIN's computer systems, under reasonable conditions of security, have evidential value with regard to the Reservations made by the Customer. 

Data on computer or electronic media constitute valid proof and as such are admissible under the same conditions and with the same probative force as any document drawn up, received or kept in writing.

HOTEL LE GRAND MAZARIN reserves the right to refuse any Reservation if it proves to be abnormally high and/or if the Customer does not respect the present General Terms and Conditions of Sale. 

The balance of the Reservation is paid directly to HOTEL LE GRAND MAZARIN at check-out. On site, payment may be made by cheque or credit card. HOTEL LE GRAND MAZARIN may request proof of identity for fraud prevention purposes. 

The customer guarantees that he/she is fully authorized to use the bank card or cheque book used, and that he/she has sufficient funds to cover the costs of the order. Under no circumstances may HOTEL LE GRAND MAZARIN be held responsible for the fraudulent use of the Customer's bank card, cheque book or bank account.

Any bank charges relating to credit card payments will be borne by the Customer. These fees correspond to any charges levied exclusively by the Customer's bank for the use of his/her bank card. 

Article 6.    CANCELLATION OF RESERVATION

The Customer is hereby informed that, in application of article L 221-28 12° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts "for the provision of accommodation services [...] which must be provided on a specific date or at a specific time". Consequently, the Customer does not benefit from the right of withdrawal provided for by the French Consumer Code in respect of the reservation of Accommodation.

However, depending on the period of stay and the rate applied, the Customer may cancel the reservation up to the day before the start of the stay, under the conditions explained in the Reservation confirmation. The customer is invited to refer to the reservation confirmation, which sets out in detail the cancellation conditions specific to the reservation made. In this case, all or part of the reservation price may be refunded. 

Any refund of the Reservation will be made using the same means of payment as that used by the Customer for the initial transaction. 

The Customer acknowledges that only the cancellation conditions mentioned in the Reservation confirmation apply to him/her, to the exclusion of any other condition. 
 

Article 7.    ACCESS TO THE SITE

Access to the Site is free to any Customer with Internet access. 

Costs relating to access to the Site, in particular Internet access, are the sole responsibility of the Customer. 
The Site is accessible at all times. 

However, HOTEL LE GRAND MAZARIN reserves the right, without prior notice or compensation, to close the Site temporarily or permanently, in particular to carry out updates, maintenance operations, modifications or changes to operating methods, servers and accessibility times.
 

Article 8.    INDIVIDUAL POLICE RECORD

In application of article R.611-42 of the French Code de l'Entrée et du Séjour des Etrangers et du Droit d'Asile, at the time of Reservation, the Customer will be asked to complete and sign a police form if he/she is not of French nationality. 

If the Customer refuses to complete and/or sign the individual police form, the Reservation will be automatically refused. 

Customer data will be processed in accordance with the Privacy Policy.

Article 9.    LIABILITY

The Customer undertakes to use the Accommodation and the Website in accordance with their intended purpose, good morals and public order. 

The Customer is responsible for ensuring that Travellers comply with these General Terms and Conditions. 

HOTEL LE GRAND MAZARIN reserves the right to remove the Customer from the Accommodation without compensation and/or reimbursement of any sums paid by the Customer for the Reservation. 

The Customer is responsible for any damage and/or deterioration to the Accommodation during the dates indicated on the Reservation confirmation.  

HOTEL LE GRAND MAZARIN shall not be held liable for any indirect damage resulting from these General Terms and Conditions, in particular operating loss, third-party acts or acts of its partners. 

HOTEL LE GRAND MAZARIN may never be held liable for any content - even illicit - external to the Site, even if the Site contains a link to said content.

HOTEL LE GRAND MAZARIN undertakes to describe with the greatest accuracy or to present a photograph of the Accommodations offered for Reservation.

However, HOTEL LE GRAND MAZARIN cannot guarantee the accuracy, precision or completeness of the information made available on the Site, which information constitutes neither a guarantee nor a commitment on the part of HOTEL LE GRAND MAZARIN with regard to the Internet user.

In all cases, HOTEL LE GRAND MAZARIN may not be held liable in the event that non-performance of its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure as defined by French case law and provided for in Article 10 of these General Terms and Conditions, or to the Customer.

HOTEL LE GRAND MAZARIN may not be held liable by the Customer for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of a computer virus. 

The Customer is responsible for the proper functioning of his/her computer equipment and Internet access. 

The same applies to any hypertext links present on the Site. 
 

Article 10.    FORCE MAJEURE

Neither HOTEL LE GRAND MAZARIN nor the Customer may be held liable if the execution of the Reservation is delayed or prevented due to force majeure or an act of God, the fault of the other party or a third party, or external causes such as industrial disputes, intervention by civil or military authorities, natural disasters, fire, water damage, interruption of the telecommunications or electricity networks.

Article 11.   INTELLECTUAL PROPERTY

All elements of the Site, whether visual or sound, including software, all intellectual property rights such as trademarks, service marks, form marks and copyright are the exclusive property of HOTEL LE GRAND MAZARIN.

Unless otherwise stated, the intellectual property rights on the documents contained on the Site and each of the elements created for this Site are the exclusive property of HOTEL LE GRAND MAZARIN, it does not grant any license or any other right other than to consult the Site.

The reproduction of any page or content of the Site by the Client or by any third party is subject to prior written authorization from the HOTEL LE GRAND MAZARIN.

The reproduction of any documents published on the Site is only authorized for the exclusive purpose of information for personal and private use, any reproduction and use of copies made for other purposes is expressly prohibited.

It is forbidden to use trademarks, images or any other element on which the HOTEL LE GRAND MAZARIN would hold intellectual property rights.

It is also forbidden to copy, modify, create a derivative work, reverse the design or assembly or in any other way attempt to find the source code (except in cases provided by law), sell, assign, sub-license or transfer in any way whatsoever any right relating to the software and the Site.

It is also forbidden to modify the Site or use modified versions of the Site and in particular (without this list being exhaustive) in order to obtain unauthorized access to the Site and to access the Site by any means other than through the interface provided by HOTEL LE GRAND MAZARIN for this purpose.

The Site and any software used necessarily in connection with it may contain confidential information and protected by the intellectual property right in force or any other law.

The Customer who has a personal website and who wishes to place, for personal use, on his website a simple link directly to the site of Le Grand Mazarin must require the prior written permission of HOTEL LE GRAND MAZARIN.

In any case, any unauthorized link must be removed at the request of HOTEL LE GRAND MAZARIN.

Article 12.   ARCHIVING AND EVIDENCE

The click made during the validation of the Reservation and the confirmation by email of the acceptance of the Reservation constitute an electronic signature which has, between the Client and HOTEL LE GRAND MAZARIN, the same value as a handwritten signature. 

The archiving of Booking confirmations and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with articles 1366 and 1367 of the Civil Code.

The electronic records of HOTEL LE GRAND MAZARIN will be considered as proof of communications, subscriptions, payments and transactions between HOTEL LE GRAND MAZARIN and the Client.

Article 13.   DISPUTE 

In case of dispute with the HOTEL LE GRAND MAZARIN the Customer must contact the HOTEL LE GRAND MAZARIN by email reservations@legrandmazarin.com or post (17 rue de la Verrerie 75004 Paris).

In case of failure of the claim request to the HOTEL LE GRAND MAZARIN or in the absence of a response within two (2) months, the Client may submit the dispute opposing it to the HOTEL LE GRAND MAZARIN to a mediator (Union Des Métiers et Des Industries de l'Hôtellerie) which will attempt, in complete independence and impartiality, to bring the parties closer in order to reach a solution. 

The Client benefits from a complaint form on the mediator’s website (here) in order to submit his request for mediation. 

The Client and the HOTEL LE GRAND MAZARIN remain free to accept or refuse the resolution of a dispute through mediation and to accept or refuse the solution proposed by the mediator.

In the absence of an amicable agreement, the court competent to resolve the dispute is the place of the defendant’s domicile or the place of performance of the Reservation. 

The Client may also, if he wishes and independently of any other dispute resolution procedure with HOTEL LE GRAND MAZARIN, use the online dispute resolution platform offered by the European Union:

These General Conditions are subject to French law. 

In case of difficulty of interpretation resulting from a contradiction between the French version and any possible version in another language, only the French version will be taken into account.
 

Article 14.   GENERAL PROVISIONS

14.1 Entire Agreement

HOTEL LE GRAND MAZARIN and the Client acknowledge that these General Terms and Conditions constitute the entire agreement concluded between them and replace any previous offer, provision or agreement, written or oral.

14.2 Good faith

HOTEL LE GRAND MAZARIN and the Client agree to perform their obligations with perfect good faith. 

14.3 Securities

In case of difficulties of interpretation resulting from a contradiction between any of the titles appearing at the head of the articles and any of the articles, the titles will be declared non-existent. 

14.4 Nullity

If any of the stipulations of these General Terms and Conditions prove null and void with regard to a rule of law in force or a judicial decision that has become final, it will be deemed unwritten, without however resulting in the nullity of all the General Conditions or altering the validity of its other provisions.

14.5 Domiciliation

The HOTEL LE GRAND MAZARIN and the Client elect domicile at the addresses indicated on the Reservation validation for the Client and at the address appearing in these General Terms of Sale for the HOTEL LE GRAND MAZARIN.
